§1 GENERAL PROVISIONS AND SCOPE OF APPLICATION

1. The Retro Mazur online store, available at www.retromazur.pl, is operated by Karolina Mazur, conducting business under the name Retro Mazur Karolina Mazur, NIP: 6252500797, REGON: 541878092, with its registered office at ul. Sienkiewicza 49C, 42-584 Wymysłów, Poland.

2. These Terms and Conditions define the rules for the sale of used products by the Retro Mazur Store to Customers in European Union member states other than Poland.

3. Contact with the Seller is possible via e-mail: biuro@retromazur.pl.

4. The Retro Mazur store website is available in Polish, English, and German. The Customer chooses the preferred language of the Terms and Conditions.

5. All prices on the Store's website are given exclusively in Polish Zloty (PLN).

6. Using the Store's international sales services means accepting these Terms and Conditions.

7. The provisions of these Terms and Conditions take precedence over the national regulations to the extent that they concern cross-border sales.

§2 DEFINITIONS

  •  
  • Customer – a natural person, legal person, or an organizational unit without legal personality, to whom the law grants legal capacity, making a purchase in the Store.  
  • Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.  
  • Entrepreneur with Consumer Rights – a natural person concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional character for this person, resulting in particular from the subject of their business activity, made available on the basis of regulations on the Central Register and Information on Economic Activity.  
  • Product – a movable item (used game, console, computer, electronic part) available in the Store.  
  • Sales Agreement – a distance contract for the sale of a Product concluded between the Customer and the Seller via the online Store.  
  • Store – the Retro Mazur online store available at www.retromazur.pl.  
  • Seller – Karolina Mazur conducting business as Retro Mazur.  
  • EU – European Union.

§3 ORDERS, PRICES AND PAYMENTS

1. Purchase Rules: The Store sells online. The products offered are used goods; their condition is individually described. Placing an order requires acceptance of the Terms and Conditions.

2. International Orders: If you are interested in ordering from outside Poland, please contact our customer service via email: biuro@retromazur.pl, by phone at +48 513 868 392, or via the online chat available on the website. Sales outside Poland are made on the basis of individual arrangements regarding the price in EUR, delivery costs, and payment.

3. Conclusion of Contract: The Sales Agreement is concluded when payment for the order is credited to the Seller's account. Confirmation of the conclusion of the contract, the content of the contract, and a link to the withdrawal form are sent to the Customer electronically. Failure to pay within 7 days of placing the order results in its cancellation.

4. Currency and VAT: Prices for international orders are set individually in Euros (€) and include applicable VAT, in accordance with applicable Polish and EU law (including the OSS procedure, if applicable).

5. Delivery Costs: Delivery costs are determined individually and depend on the destination country, the type and size of the shipment, and the selected carrier.

6. Payment Methods: Online payments using the Stripe system (credit cards, other local payment methods available in Stripe). Traditional bank transfer to EUR account:

7. Age Restrictions: Products with PEGI ratings are sold only to individuals who meet the age requirements. The Seller reserves the right to refuse to fulfill an order that does not comply with the PEGI classification.

§4 DELIVERY

1. Deliveries are made to the territory of European Union member states.

2. Shipments are carried out via Apaczka.pl or other reputable international carriers.

3. The estimated order fulfillment time is 3–10 business days, counting from the date of payment crediting. Delivery time may vary depending on the destination country.

4. The Customer bears the delivery costs. Any additional fees, such as customs duties or local taxes (if applicable in special territories within the EU, e.g., Canary Islands, which have a separate customs status), are borne by the Customer and are added to the Product price or collected by the carrier upon delivery, unless otherwise provided by law or individual arrangements.

§5 SELLER'S LIABILITY FOR CONFORMITY OF GOODS WITH THE CONTRACT AND COMPLAINTS

1. Conformity of goods with the contract (applies to Consumers and Entrepreneurs with consumer rights): The Seller is liable for the conformity of the goods with the contract on the terms specified in the Act of May 30, 2014, on consumer rights (Polish Law), taking into account the protection resulting from the unconditionally applicable provisions of the law of the Consumer's country of habitual residence.

2. In case of non-conformity of the goods with the contract, the Customer (Consumer or Entrepreneur with consumer rights) has the right to demand repair or replacement of the goods. If repair or replacement is impossible or would involve excessive costs, the Customer may demand a price reduction or withdraw from the contract.

3. The Seller responds to a notification regarding non-conformity of goods with the contract within 14 days from the date of its receipt. Failure to respond within this period means acceptance of the complaint.

4. Warranty (applies to Customers who are not Consumers or Entrepreneurs with consumer rights): In relation to Customers who are not Consumers or Entrepreneurs with consumer rights, the Seller is liable under the warranty for physical or legal defects of the Product under the provisions of the Civil Code. The warranty period for used products is 1 year from the date of delivery.

5. Complaint procedure: Complaints should be submitted via e-mail to: reklamacje@retromazur.pl, including the first name, last name, e-mail address, order number, and a detailed description of the problem.

§6 RIGHT OF WITHDRAWAL FROM THE CONTRACT

1. A Customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the Sales Agreement without giving any reason within 14 days of receiving the goods.

2. To exercise the right of withdrawal, an unambiguous statement of withdrawal from the contract should be sent to one of the following addresses:

4. In the event of withdrawal from the contract, the Customer bears the direct costs of returning the goods to the Seller. The Seller does not refund the return shipping costs.

§7 PERSONAL DATA PROTECTION AND COOKIES

1. The administrator of personal data is Karolina Mazur, operating Retro Mazur.

2. Personal data is processed for the purpose of order fulfillment, account management, marketing (with consent), invoicing, in accordance with GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council) and Polish personal data protection regulations.

3. The Customer has the right to access, rectify, restrict processing, and delete their data.

4. Detailed information is contained in the Privacy Policy available on the Store's website.

5. The Store uses cookies to ensure proper operation of the website, for analytics and marketing, in accordance with EU regulations. The user can manage cookies using browser settings.

§8 FINAL PROVISIONS

1. These Terms and Conditions are governed by Polish law. The choice of Polish law does not deprive the Consumer of the protection granted to them by provisions that cannot be excluded by agreement, based on the law of the country where the Consumer has their habitual residence.

2. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the Consumer Rights Act, and other applicable provisions of Polish and European Union law apply.

3. Disputes arising from the performance of the Sales Agreement will be resolved by the court competent for the Consumer's place of residence.

4. The Customer may use out-of-court dispute resolution methods, including the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr.
